Offer Agreement
This document constitutes an official offer (public offer) by the online store Problemes, located at problemes.store (hereinafter referred to as the “Seller”), to enter into a contract for the sale of goods by distance selling under the terms and conditions set forth below.
Placing an order on the Website constitutes the Buyer’s full and unconditional acceptance of the terms of this Offer.
1. GENERAL PROVISIONS
1.1. This Offer constitutes a public contract in accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine.
1.2. The Seller sells goods through the online store problemes.store.
1.3. A “Buyer” is any individual or legal entity that has accepted the terms of this Offer and placed an order on the Website.
1.4. Acceptance of this Offer is deemed to occur when the Buyer places an order on the Website and pays for it.
2. SUBJECT MATTER OF THE AGREEMENT
2.1. The Seller agrees to transfer ownership of the goods presented on the Website to the Buyer, and the Buyer agrees to pay for and accept the goods in accordance with the terms of this Offer.
2.2. The product name, specifications, package contents, and price are listed on the product’s page on the Website.
3. TO CHECKOUT
3.1. The Buyer places an order through the Website on their own.
3.2. To place an order, the Buyer shall provide accurate information necessary for fulfilling the order.
3.3. The Seller shall not be liable for the consequences of the Buyer providing inaccurate or incomplete information.
4. PRICE OF THE GOODS AND PAYMENT PROCEDURE
4.1. The price of goods is listed on the Website in Ukraine’s national currency—the hryvnia.
4.2. Payment for orders on the Website is made exclusively through full prepayment.
4.3. The Seller has the right to unilaterally change the prices of goods until the Buyer places an order.
4.4. Shipping costs are not included in the price of the merchandise and are paid separately by the Buyer in accordance with the carrier’s rates.
5. DELIVERY OF GOODS
5.1. Goods are delivered throughout Ukraine by the Nova Poshta delivery service.
5.2. The estimated shipping time for in-stock items is 1 to 3 business days.
5.3. The estimated shipping time for pre-ordered items is 7 to 14 business days.
5.4. The terms and conditions for international shipping are set forth in a separate section of the Website titled “Shipping and Payment.”
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
The seller is required to:
• to deliver goods of proper quality to the Buyer;
• to provide accurate information about the goods;
• to fulfill the order in accordance with the terms of this Offer.
The buyer is required to:
• Provide accurate information when placing an order;
• Pay for the order on time;
• Accept and inspect the goods upon receipt.
7. EXCHANGES AND RETURNS
7.1. Exchanges and returns of goods are carried out in accordance with the applicable laws of Ukraine and the terms and conditions set forth in the “Exchanges and Returns” section of the Website.
7.2. The buyer has the right to exchange or return the merchandise within 14 calendar days of receiving the order, provided that the established requirements regarding the condition of the merchandise are met.
8. LIABILITY OF THE PARTIES
8.1. The parties shall be liable for any failure to perform or improper performance of their obligations in accordance with the applicable laws of Ukraine.
8.2. The Seller shall not be liable for delivery delays caused by the operations of postal services, customs authorities, or other circumstances beyond the Seller’s control.
8.3. The color of the product in the photos may differ slightly from the actual color due to variations in color reproduction across different devices.
9. CONFIDENTIALITY
9.1. The Buyer’s personal data is processed in accordance with the Privacy Policy posted on the Website.
10. FINAL PROVISIONS
10.1. The relationship between the Buyer and the Seller is governed by the applicable laws of Ukraine.
10.2. The Seller has the right to make changes to this Offer without prior notice to the Buyers.
10.3. The current version of the Offer is always available on the Website.
